Major Expansion of Unionization Proposed in New Legislation Affecting All Employers
With a new President Elect comes the promise of expanded and far-reaching unionization through the proposed - Employee Free Choice Act (EFCA). Congress is poised to take up the legislation early in the new congressional session.
If passed, the EFCA would foster the most radical expansion of unionization since the 1930s. The EFCA eliminates secret ballot union elections in favor of a process that would make it much easier for unions to gain representation rights over your workforce. In addition, the law would reduce employer bargaining power in negotiating first contracts by allowing third party arbitrators to impose a contract on both employers and employees. Many of these arbitrators have no vested interest in an employer's success. Furthermore, employers that are currently unionized face the prospect of expanded unionization in their facilities. Organized labor considers the EFCA its top legislative priority. It has passed the House, and awaits a Senate vote. President-elect Obama stated he would sign the bill if came to his desk.
It is important to prepare your company now in the event that this bill becomes law.
