Archived Webcast (On Demand Course): The Undue Hardship of Disability Accommodation: Guidelines for Handling Accommodations

This course is designed for supervisors, managers and human resource personnel.

Employers must provide reasonable accommodation to qualified individuals with disabilities who are employees or applicants for employment, unless to do so would cause undue hardship to the employer. Identifying a reasonable accommodation requires a particularized inquiry into the exact nature of the individual's disability and the details of the job in question. There are no "cookie cutter" tests to determine a reasonable accommodation for all employees; it is determined on a case by case basis and involves input from the employee, medical professionals and managers. This course will provide a step-by-step process for evaluating accommodation requests by employees, determining what accommodations are reasonable and what would cause hardship to the employer.

Topics that will be covered include:

  • Overview of state and federal disability laws, including 2009 amendments to the Americans with Disabilities Act
  • Employee requests for reasonable accomodations
  • Documentation validating need for accommodation
  • Types of reasonable accommodation
  • Examples of undue hardship
  • Management of employees who receive accommodation

After completing this course, participants will be able to:

  • Engage in the interactive process with employees requesting accommodation
  • Properly document interactive process
  • Prepare appropriate communciations to employee and employee's health care providers regarding accomodation
  • Understand the difference btween accommodation and light duty jobs pursuant to workplace injury
  • Comply with privacy rights of employees related to disability accommodation
  • Evaluate when an accommodation will cause an undue hardship
