Ensuring Your Employment Records and Personnel Files are in Compliance

This course is designed for human resource professionals.

The older a company gets, the more records it's required to generate and retain. Many employers make the choice to destroy their employment records in an effort to save space and costs. Unfortunately, many of those employers are unaware of how long the law requires them to retain certain records. Maintaining personnel and other employment records requires finding a balance between efficient administration and complying with all the legal requirements where an employer is held accountable.

Topics that will be covered include:

  • What records belong in an employee's personnel file and who should have access to it?
  • What records relating to a person's employment should be kept in a separate file?
  • Where does leave request information, L&I paperwork and disability information on employees belong?
  • How long must an employer store personnel files and other employee information?
  • What are the federal electronic discovery rules?
  • How does the Lilly Ledbetter Fair Play Act impact the employer's duty to store employee pay records?

After completing this course, participants will be able to:

  • Conduct an audit of your record retention process
  • Understand the different legal requirements for storage of employee information, including medical and immigration information
  • Determine when to shred personnel records or other information related to employees
  • Understand requirements related to retention of job applications
  • prepare a record retention policy
