Eliminating Interviewing and Selection Process Missteps

This course is designed for human resource professionals.

When interviewing a prospective job candidate, you may be tempted to ask questions such as these:

"Do you have childcare arrangements?"

"Have you ever had a prior injury on the job?"

"Did you receive an honorable discharge from the military?"

An untrained interviewer who asks questions such as these may end up exposing both the company and themselves to a claim of discrimination. The same could be true if the company is not using valid and reliable pre-employment tests or assessments.

Increasingly, applicants and governmental agencies are questioning a company's hiring decisions based on interviewing irregularities, application forms, and screening methodologies. This course will help interviewers understand the numerous regulations that affect the interviewing and selection process in order for them to avoid any improper queries or testing that may lead to an adverse action against the company.

Topics that will be covered include:

  • Ensuring all interview and application questions are legal; recognize illegal or potential "gray" areas
  • Distinguishing between disparate treatment and disparate impact
  • Tips on evaluating a resume and/or an employment application
  • Conducting a job analysis to identify the essential functions of a position in accordance with the Americans with Disabilities Act (ADA)

After completing this course, participants will be able to:

  • Explain the one "secret" that will keep interviewers from getting into legal trouble in an interview situation
  • List a dozen factors upon which employment decisions may not be based
  • Tell five ways job descriptions assist management and help an employer defend themselves legally, if necessary
  • Discuss common hiring practices that lead to charges of disparate treatment or disparate impact
  • Calculate whether disparate-impact levels exist in the company for whom you work
  • Develop recovery techniques in case the applicant volunteers in appropriate information
  • Create a structured employment interview and legally sound selection process for any position in the company
